Man Banned from Flying Asks Supreme Court to
Block Federal Transportation Mask Mandate

A fully vaccinated frequent traveler unable to wear a mask submitted an emergency application today to the U.S. Supreme Court asking it to enjoin the government from enforcing the Federal Transportation Mask Mandate pending a final resolution of his lawsuit in the U.S. District Court in Orlando.

Lucas Wall, 44, of Washington, D.C., sent the application and appendix to Justice Clarence Thomas, who oversees federal courts in the 11th Circuit. Wall requests Thomas issue a preliminary injunction against the Centers for Disease Control & Prevention, Transportation Security Administration, and other federal agencies to stop the mask mandate everywhere. He needs emergency relief no later than July 16 so he can take a July 17 flight to Germany, a trip he’s already had to postpone twice.

3rd Lawsuit Filed Challenging
Federal Transportation Mask Mandate

A rideshare driver not willing to leave customers on the side of the road for not wearing a mask filed a federal lawsuit June 28 against the Centers for Disease Control & Prevention, U.S. Department of Health & Human Services, Illinois Gov. JB Pritzker, and the Illinois Department of Public Health requesting a federal judge strike down the Federal Transportation Mask Mandate.

Justin Mahwikizi, 36, of Homewood, Illinois, alleges the mask mandate violates his freedom of religion by forcing him to violate his faith in the Good Samaritan Principle, which requires helping those in need. The FTMM forces Mahwikizi to refuse service to riders who can’t or won’t cover their face – or even those who simply forgot to bring a mask since they are no longer required in Illinois for the fully vaccinated.

Media Coverage of Lucas Wall’s
Mask & Testing Lawsuits June 2021

I’m challenging the Federal Transportation Mask Mandate and International Traveler Testing Requirement in the U.S. District Court for the Middle District of Florida (Wall v. CDC). I’m also suing seven airlines for illegally discriminating against passengers with disabilities who can’t tolerate wearing face masks (Wall v. Southwest Airlines). Here’s media coverage of my two cases during June 2021:

Traveler Asks Court to Stop Enforcement of COVID-19 Test Requirement for International Flyers

A fully vaccinated frequent traveler planning to visit his brother and sister-in-law in Germany next week filed tonight a motion for preliminary injunction to block the federal government from enforcing the International Traveler Testing Requirement. The lawsuit is before the U.S. District Court in Orlando.

Lucas Wall, 44, of Washington, D.C., opposes having to pay for a COVID-19 test on his return flight to the United States scheduled June 30 from Frankfurt, Germany. The ITTR has been in effect since Jan. 26 and applies even to those who are fully vaccinated and/or naturally immune from coronavirus.

Frequent Flyer Sues 7 Airlines for Discriminating Against Passengers Who Can’t Wear Masks

A frequent traveler unable to wear a mask filed suit today against Southwest Airlines, Alaska Airlines, Allegiant Air, Delta Air Lines, Frontier Airlines, JetBlue Airways, and Spirit Airlines for discriminating against passengers with medical conditions that prevent them from wearing face masks in violation of the Air Carrier Access Act. This case appears to be the first in the nation to challenge airline policies that make it practically impossible to obtain an exemption from the Federal Transportation Mask Mandate.

Lucas Wall, 44, of Washington, D.C., was stopped from boarding his Southwest Airlines flight June 2 from Orlando to Fort Lauderdale for not wearing a face covering despite having submitted the required exemption form to Southwest on May 31 when he booked his ticket. Wall suffers from Generalized Anxiety Disorder, which causes him hyperventilation and panic attacks when he tries to cover his mouth and nose.

Frequent Flyer Asks Court to Restrain Enforcement

A fully vaccinated frequent traveler unable to wear a mask filed this evening an emergency motion for a temporary restraining order to stop the government from enforcing the Federal Transportation Mask Mandate. The lawsuit is before the U.S. District Court in Orlando.
